Partition of Land

The Probate and Family Court has the exclusive jurisdiction of all petitions for the partition of land in probate cases.  These cases usually arise from a disposition of land to more than one person under a will.  One person may wish to sell the land, while the others may wish to keep it, or the owners of the land may wish to divide the land into separate parcels owned individually instead of continuing joint ownership.  The Court will determine the extent of the partition and the ownership shares.
